All Terms & Conditions are subject to the terms & conditions of the Lessor’s Vehicle Rental Agreement which will be provided to the Hirer prior to the hire period.
1. Insurance
• Fully Comprehensive Insurance included for the Hirer/Insured Driver ONLY. All drivers are subject to approval by the Insurance Company. Other drivers are not allowed to drive the car under any circumstances. Additional driver insurance is available on request. Vehicle must remain within British mainland or the insurance is void. Overseas insurance may be available on request.
• The Hirer may use the vehicle for the purpose of their business and for social domestic and pleasure purposes. The vehicle may not be used for any purposes for which they are not expressly designed. Further, the Hirer will not use or permit the vehicle to be used for hire, driving tuition, towing, racing or pace-making, or for competing in any rally, or any other form of motor sport, track days, or for any illegal purpose whatsoever.
• Breakdown cover is included.
• Hirer’s liability is restricted to the damage deposit of any insurance claim, referred to in the hiring schedule as an excess. If the hirer jeopardises the insurance cover by irresponsible actions, i.e. driving on a track, airstrip etc, letting someone else drive the car, turning off the traction control or by ignoring the insurance stipulations or not declaring drink/drugs related offences in the last 10 years, then the hirer will be responsible for the full value of any resulting uninsured losses.
2. Driver Information/Identification
• Aged between 18-70 years. (Drivers aged 18, 21, 25, 30 on application)
• Driver must have held a full UK or EU (manual) driving licence for minimum 5 years.
• No persons engaged in professional entertainment or professional sports without the specific approval of the insurance company.
• Driving Offences – maximum of 2 speeding offences in the past 5 years. No driving bans or convictions for drink/drug driving or dangerous/careless driving within the past 10 years. Maximum of 1 accident (whilst driving) in the past 5 years.
• Passport; 2 utility bills (last 3 months);& current driving licence required for verification of identity prior to vehicle hire.
• Car handover may be filmed for added security of both parties.
3. Hire Times/Mileage Allowance Each 8hr hire includes 75 miles.
• Each 24hr hire includes 100 miles.
• Each Long Weekend hire includes 300 miles.
• Additional mileage costs £5.00 per mile (or part thereof) over the inclusive miles above.
• Return of the vehicle outside of the hire hours as shown on the Hire Agreement will incur additional charges. Hire period extensions must be agreed with ADS in advance and failure to do so will result in the withdrawal of all insurance cover.
• Maximum continuous rental period is 30 days. There is no minimum period.
4. Payment/Deposit/Excess
• A non-refundable booking fee of £100 is payable to reserve each car. The balance of the hire costs must be paid 2 months prior to the hire date or in full if booking is made within 2 months of proposed hire date.
• A £5,000 returnable security deposit is required per vehicle hire. This is processed as a Debit or Credit Card “pre-authorisation” on the day prior to the hire.
• We reserve the right to increase the security deposit prior to hire of vehicle, subject to notification
• The returnable security deposit is used as:
1) A security bond.
2) For payments towards any mechanical damage which is not covered by the Insurance. E.g. Tyres, wheels, clutch, gearbox, etc. which was sustained
during the hire period due to a misuse and abuse, excluding normal wear and tear.
3) Insurance Excess against any accidental damage, loss or theft caused to the vehicle by the hirer or a third party.
4) Any additional charges incurred during the hire period, E.g. excess mileage, petrol reimbursements costs, parking charges, speeding fines, etc.
5. Cancellation/Charges
• The booking is not valid until confirmed by the Lessor Company. The following charges apply for cancellation by the Hirer:
• Less than 14 days: 100% of hire charges & booking fee.
• 15 – 28 days: 75% of hire charges & booking fee.
• 29 days – 2 months: 50% of hire charges & booking fee.
• The £100 booking fee is non-refundable.
6 General
• All cars are subject to availability.
Actual vehicle specifications may vary subject to availability. Whilst every endeavour will be made to supply the make and type of vehicle, the Lessor cannot bind itself to do so, as circumstances beyond its control may prevent this.
• Driving may be postponed in extreme weather conditions (e.g. strong winds, snow or flooding) which could make driving the cars potentially dangerous. Please call us to confirm
if relevant.
• Liability is limited to a refund of the hire charge. No consequential loss liability will be covered.
• Smoking is not permitted inside the cars and no pets allowed in the cars.
1. Whilst every endeavour will be made to supply the make and type of the vehicle, the Lessor cannot bind itself to do so, as circumstances beyond its control may prevents this.
a) For the purpose of this agreement Vitesse Supercars Limited is referred to as the Lessor.
b) The “Hirer” means the person, firm or organisation by or on behalf of whom this agreement is signed.
c) Authorised Driver means the driver(s) additional to the Hirer, approved as specified overleaf.
d) The Hirer will ensure that any authorised driver will comply with all conditions of this agreement.
2. The Hirer undertakes to return the vehicle in a clean condition with all tyres, tools, stereo and other accessories in the same condition as when received, ordinary wear and tear accepted, to the place and on the date set down on the rental agreement. No smoking will be permitted inside of the vehicle.
3. The contract of hire is conditional on:
a) The acceptance by the insurers of the hirer for insurance and
b) The correctness of statements made by the hirer on the hire agreement. If any incorrect or untrue statement shall be made therein whereby the insurance is liable to be invalid dated, the contract shall be void except that the hirer shall indemnify the Lessor from and against loss or damage to the vehicle, and all actions, claims and liability for which the Lessor may be responsible and shall cause the vehicle to be returned to the Lessor’s premises in as good state of repair as it was when issued to the hirer and shall pay the agreed rate of hire until it shall be so returned.
c) The Hirer being over the age of 30 and under the age of 70 years. Certain endorsements occupations, nationalities, and more than one accident during the past 3 years may affect the insurance terms. Please check first.
4. The hirer is responsible for hire charges from the time the vehicle leaves the garage until the vehicle returns. Charges will be debited from the damage deposit. All damage deposits are authorised from a credit or debit card. Most credit cards welcome.
(a) All hire charges and damage deposits are required in advance of the vehicle leaving the garage.
5. The hirer must sign the Lessor’s Hire Agreement. No booking is binding on the Lessor until the Lessor’s Hire Agreement is completed and signed by the hirer and accepted on behalf of the Lessor when the total amount of hire charge is paid as confirmation of a booking. This fee will be non-returnable in the event of cancellation regardless of reason. Money paid on a contract cannot be transferred to any other vehicle on any other date.
6. The hirer and any person intending to drive the vehicle must sign the Hiring Agreement or any supplementary agreement appertaining thereof.
7. British drivers must produce a current (manual) British Licence; visitors from overseas would be required to produce a valid domestic licence or an international driving permit.
All drivers must have held a full licence for a minimum of 5 years. A current licence must be produced before commencement of hire.
8. For each hour to part thereof by which a vehicle is retained by the Hirer after the termination of hire an additional charge of £100 shall be due PROVIDED ALWAYS that where a vehicle is retained by the Hirer after the termination of hire for the day then in addition to the hourly charge of £100 a further charge of one complete days hire charge shall also be due for each period of twenty-four hours or part there of during which the vehicle is so retained unless originally hired on an hourly rate where the full hourly rate will be applicable. Should the vehicle not be returned by the hirer in accordance with the conditions of hire, the Lessor reserved the right to take whatever steps they consider necessary to regain possession thereof and
the deposit will be retained and applied towards making good any loss or expenses incurred by the Lessor.
10. All damage, not considered by the Lessor to be fair wear and tear will be the hirer’s responsibility.
a) Any damage caused whilst the vehicle is left unattended, will be the hirer’s responsibility.
b) Unexpired hire, resulting from an accident or theft cannot be refunded, or hire transferred to another vehicle unless the repair is executed before expiry of the hire.
11. Subject to the conditions 9 and 10, the Lessor shall reimburse the hirer the cost of repairs arising from mechanical failure not due to any act or the fault of the hirer on production of a receipted account.
12. Every endeavour is made by the Lessor to keep its vehicles in serviceable condition, but the Lessor does not warrant that any vehicle is in such condition and will accept no responsibility for loss, damage or injury sustained as a result of a breakdown. The hirer, however, shall be entitled to the benefit of all moneys paid to the Lessor under its insurance policy so far as they relate to any such loss, damage or injury suffered by the hirer.
13. A recovery service is available for all vehicles.
14. All vehicles are covered by fully comprehensive insurance cover as defined in the specimen policy, which is available for inspection on request.
15. All accidents must be reported to the Lessor immediately.
16. The vehicle may not be taken out of Great Britain without consent in writing of the Lessor.
17. The hirer shall be liable as owner of the vehicle in respect of:
a) Any of the following offences, which includes but is not limited to speeding offences, parking offences and loading offences, which may be committed with respect to that vehicle when it is stationary and when a fixed penalty notice is issued being on the road during the hours of darkness without the lights or reflectors required by law: waiting, or bring left or parked or being loaded or unloaded, ‘in the road, being used or kept on a public road within the meaning of the Vehicles (Excise) Act 1971 without a licence under that Act being exhibited on the vehicle in the manner prescribed under the Act; and the non-payment of the charge made at a street parking place; and;
b) Any excess charge which may be incurred in pursuance of an order Sections 35 and 36 of the Road Traffic Regulations Act 1967 (provisions on highways of parking places where charges are made). Any charges arising from the vehicle being compounded, for whatever reason or being towed/recovered/removed will be payable by the hirer.
The hirer indemnifies the Lessor against any and all losses/charges/fines and penalties that are incurred during the course of the hire whether they are known or unknown at the time of the hire, thus including all such losses/charges/fines and penalties that the Lessor becomes aware of after the hirer has returned the vehicle. In the event that the Lessor has to deal with any losses/charges/fines and penalties then the hirer will pay a minimum administration charge of £35 in addition to any charges levied. In respect of compound fees the admin charge will be £250 in addition to any charges levied.
18. The Hirer in the event of an accident must not admit liability or offer any sums in payment to any third parties whether the hirer is at fault or not. Furthermore, the Hirer must contact the Lessor immediately and must not arrange for any recovery, repairs or inspections until and unless specifically authorised to do so by the Lessor.
19. The Hirer must use the vehicle in accordance with the laws of the United Kingdom and also in accordance with the usage limitations contained herein. Vehicles are fitted with trackers that monitor the use of the vehicle. Excessive speed will alert the Lessor who will then, at the sole discretion of the Lessor, be permitted to terminate the hire with immediate effect and in some circumstances bring the vehicle to halt. All rental charges will be retained in the event that the hire is terminated by virtue of the hirer’s misuse of the vehicle and/or breach of the terms stated herein.
20. By signing the hire agreements and accepting the car at handover, the hirer is then not entitled to claims under the “money back guarantee” offer.
